Geltungsbereich

Der Vertrag tritt bei Anmeldung (mündlich, telefonisch, Post oder online) in Kraft und endet automatisch nach bestandener Führerprüfung oder mit Ende eines Kurses.

Fahrlektionen

Eine Fahrstunde dauert 45-50 Minuten, inkl. Instruktionen, Schlussbesprechung und Terminvereinbarung. Die Fahrlektionen beginnen an einem vom Fahrlehrer vereinbarten Standort. Muss der Schüler abgeholt werden, so geht die Zeit für Hin- und Rückfahrt zu Lasten des Schülers.

Vereinbarte Lektionen müssen 48 Stunden (2 Arbeitstage) vor Lektionsbeginn abgemeldet werden, ansonsten werden sie in Rechnung gestellt. Liegt der Fahrschule vor dem jeweiligen Dienstleistungsbeginn ein Arztzeugnis vor, so liegt es im Ermessen der Fahrschule, von der Verrechnung abzusehen. Verspätetes Erscheinen zum vereinbarten Termin gehen zu Lasten des Schülers. Der Fahrlehrer ist verpflichtet, 10 Minuten bis nach der vereinbarten Zeit zu warten. Die Fahrlektion ist vom Schüler zu bezahlen. Falls Zweifel an der Fahrfähigkeit bestehen, bspw. wegen Konzentrationsschwäche, Müdigkeit, Medikamente, Alkohol oder Drogen, kann die Lektion jederzeit abgebrochen und vollumfänglich in Rechnung gestellt werden.

In der Regel hat der Fahrschüler die jeweiligen Dienstleistungen wie Fahrlektionen und Kurse vor Beginn der jeweiligen Lektion bar zu bezahlen. In Ausnahmefällen werden Rechnungen gestellt oder ein Einzahlungsschein mitgegeben, wobei pro Rechnung CHF 10.00 Bearbeitungsgebühr erhoben werden. Die Rechnungen sind sofort bei Erhalt und bei Kursen vor Kursbeginn zu bezahlen. Gerät der Kunde mit einer Zahlung in Verzug, so wird ein Verzugszins von 5% berechnet. Bei Mahnungen wird eine Bearbeitungsgebühr von CHF 40.00 verrechnet. Wenn nach der ersten Mahnung die Rechnung nicht sofort beglichen wird, leitet die Fahrschule die Betreibung ein.

Versicherung

Von der Fahrschule Roadrunner wurde eine Fahrschul-Versicherung abgeschlossen, an der sich alle Fahrschüler der Fahrschule Roadrunner obligatorisch mit einem Beitrag beteiligen müssen. Diese Versicherung ist 2 Jahre gültig und deckt Schäden, welche aufgrund der Dienstleistung der Fahrschule Roadrunner, die während des Fahrunterrichts und der amtlichen Führerprüfung mit den Fahrzeugen der Fahrschule entstehen (inkl. Vollkasko). Eine Rückzahlung ist ausgeschlossen. Die Versicherung beschränkt sich explizit auf die Fahrzeuge der Fahrschule Roadrunner.

Gerichtsstand

Es gilt Schweizerisches Recht. Gerichtsstand ist der Sitz der Fahrschule Roadrunner.

Terms: “driving school” refers explicitly to the driving school Roadrunner. “Instructor” refers explicitly to the driving instructor

Area of application

This contract takes effect immediately upon application whether such application be oral, by telephone, by postal service or online. This contract ends automatically upon the successful passing of the driving test or at the end of a previously agreed course.

Driving lessons

One driving lesson lasts 45-50 minutes and includes instruction, end-of-lesson-review and arranging the next lesson. Each lesson starts at a location previously agreed upon with the instructor. In a case where the pupil has to be collected, the instructor’s travelling time to and from this collection point will be at the expense of the pupil.

Lessons agreed upon have to be cancelled within 48h (two working days) ahead of the lesson otherwise the missed lesson will be charged. If, in case of sickness, a doctor’s attest is submitted to the driving school in good time before the start of the lesson, any decision to charge will be at the discretion of the instructor.

Late arrival to a lesson will be charged to the pupil. The instructor is obliged to await the arrival of the pupil for 10 minutes after the agreed start of the lesson. After that time the instructor will leave. The driving lesson will be paid for by the pupil. In case of any doubt concerning the ability to drive, for example a lack of concentration, tiredness, medication, inebriation or drug consumption, the instructor reserves his right to cancel the lesson at any time. The cancelled lesson will be charged in full to the pupil.

As a rule the driving pupil will pay for each service such as driving lessons and courses in cash before the start of each lesson. In exceptional cases an invoice or a pay-in slip can be supplied at a cost of CHF 10.00 per invoice or pay-in slip. Invoices are to be settled immediately upon receipt or in case of courses before the commencement of the course. Invoices settled with a delay are subject to a 5% interest of the invoice amount, additionally charged to the customer. An administrative fee of CHF 40.00 will be applied for every payment reminder. If payment is not made immediately after receipt of the first reminder, the driving school will initiate enforcement procedures.

Insurance

The driving school Roadrunner is covered by insurance and a mandatory amount towards this insurance is paid by each pupil of this driving school. No refund of this insurance will be granted. This insurance is fully comprehensive and is valid for two years. It covers damages in connection with the services of the driving school during driving lessons and the official driving exam and only when vehicles of said driving school are in use. This insurance covers only and explicitly the vehicles of the driving school Roadrunner.

Jurisdiction

All legal relationships with this driving school are applicable to Swiss law. Jurisdiction is the seat of the driving school.

Ámbito de aplicación
El contrato entra en vigor al inscribirse el alumno / la alumna, sea verbalmente, por teléfono, por correo o por correo electrónico y queda derogado automáticamente al aprovar el examen o llegando al final de un curso.

Clases de conducción

Una clase de conducción dura de 45 a 50 minutos e incluye las instrucciones, la concertación de la próxima cita y la reunión final.
La clase de conducción comienza en un lugar, determinado por el profesor de autoescuela. Por si acaso hay que buscar o/y llevar al alumno, el tiempo de ida y vuelta corre a cargo del alumno.

Citas concertdadas pueden ser suspendidas con 48 horas de anticipación, decir, dos días laborables, sino se cargan en cuenta del alumno.

Si el alumno presenta un certificado médico, la compensación de la clase está en la discrecionalidad del profesor. El profesor se compromete a esperar diez minutos contando de la hora concertada.

Si cabe duda de la aptitud física y mental de conducir del alumno (por ejemplo a causa de consumición de drogas, alcohol o medicamentos), el profesor puede suspender la clase en cualquier momento, cobrándola enteramente. Por lo general, el alumno paga la clase al contado al final de ella.

Sólo en casos excepcionales se entrega una factura junto con un resguardo de ingreso cobrando un suplemento de CHF 10.00. La factura se paga después de la recepción de ella o antes de que empiece el curso. Si el cliente demora en pagar, se cobrarán intereses moratorios por un importe del 5% del valor total. Por el primer aviso se cobrará por gastos administativos CHF 40.00. Si la factura queda aun así sin pagar, la autoescuela se ve obligada a iniciar un embargo.

Seguro

La autoescuela ha contratado un seguro de autoescuela al cual cada alumno contribuye. Este seguro es válido durante dos años y cubre daños, provocados durante las clases, durante el examen oficial y también incluye el seguro a todo riesgo. Un reembolso no es posible.
El seguro se limita explícitamente a automóviles de la autoescuela "Roadrunner ".

Jurisdicción

Todas las relaciones legales con esta escuela de manejo son aplicables a la ley suiza. La jurisdicción es la sede de la escuela de manejo.
